RUPTURE
Serious misconduct is that which makes it impossible for the employee to remain in the company. Since the employee, dismissed for serious misconduct by letter of 22 December, continued to work in the company until 31 December, it follows that the employer considered that the facts invoked did not exclude his continued employment with the company and therefore did not constitute serious misconduct (Cass. soc. 9-10-2024 no. 22-19.389 FD).
